Paddie Injury Waiver and Release of Liability

IMPORTANT: PLEASE READ CAREFULLY


By booking a session with Paddie, you (the "Participant") acknowledge and agree to the following terms regarding participation in pickleball sessions and activities provided by Paddie ("Company," "we," "our," or "us").

1. Assumption of Risk

Participation in pickleball-related activities, including but not limited to drills, sessions, and use of equipment (the "Activities"), involves inherent risks of injury. These risks may include, but are not limited to, injuries resulting from:

  • Accidents or falls during drills or activities.

  • Strains, sprains, or other injuries related to physical exertion.

  • Improper use of the equipment or failure to follow safety instructions.

  • Collisions, overexertion, or other unforeseen incidents.

The undersigned Participant acknowledges these risks and voluntarily chooses to engage in the Activities.

2. Waiver and Release

In consideration for the opportunity to participate in Paddie’s activities, the Participant, on behalf of themselves, their heirs, executors, personal representatives, and assigns, hereby releases and forever discharges Paddie, its officers, employees, agents, and contractors from any and all liability, claims, demands, actions, or causes of action that may arise from injuries, damages, or losses incurred during participation in the Activities, including injuries caused by negligence.

This release applies to all claims, whether personal, property, or financial, arising from participation in the Activities, and extends to any injuries or damages resulting from the use of the Titan One machine, equipment, or other materials provided by Paddie.

3. Indemnification

The Participant agrees to indemnify and hold harmless Paddie, its officers, employees, agents, and contractors from any and all claims, demands, damages, actions, losses, or expenses (including attorney's fees) arising out of or related to the Participant’s participation in the Activities.

4. Medical Considerations

The Participant certifies that they are in good physical condition and capable of participating in the Activities. If the Participant has any medical conditions or limitations that might affect their ability to safely participate, they must disclose this information prior to booking or participation. It is recommended that participants consult with a healthcare provider before beginning any physical activity.

5. Acknowledgment of Safety Procedures

The Participant agrees to follow all safety instructions provided by Paddie during the Activities, including but not limited to:

  • Proper warm-up and cool-down practices.

  • Correct use of equipment, including the Titan One machine.

  • Compliance with any warnings or instructions provided by the Paddie team.

Failure to adhere to safety procedures may result in the Participant being asked to leave the session at Paddie's discretion.

6. No Warranty on Equipment

While Paddie makes every effort to ensure the safety and functionality of the equipment used during sessions, we do not warrant the fitness of the equipment or guarantee the prevention of any injury or damage. The Participant accepts responsibility for using the equipment as instructed.

7. Governing Law

This waiver and release shall be governed by the laws of the State of Wyoming, without regard to its conflicts of law principles.

8. Acknowledgment of Understanding

By booking and participating in a session with Paddie, the Participant acknowledges that they have read and fully understand the terms and conditions of this Injury Waiver and Release of Liability. The Participant voluntarily and knowingly agrees to the terms outlined above.
